1. Acceptance of Terms

By accessing or using the website at https://www.missingskincare.com (“Site”) and any related services (collectively, the “Services”) provided by Missing Space LLC, doing business as Missing Skincare (“Company,” “we,” “us,” or “our”), you (“you” or “User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our Site or Services.

2. Eligibility

You must be at least 15 years old to use our Site or Services. By using the Site, you represent and warrant that you meet this age requirement.

3. Services Provided

Missing Skincare provides automated skincare routine recommendations based on user-submitted information and offers optional expert consultation services for a fee. All recommendations are based on information provided by the user and do not constitute medical advice.

4. Account Registration and Security

  • To access certain features, you may be required to create an account.
  • You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Notify us immediately of any unauthorized use or suspected breach of security.

5. User Responsibilities

  • You agree to use the Site and Services only for lawful purposes.
  • You will not misuse, copy, modify, distribute, or exploit any part of the Site except as expressly permitted.
  • You agree not to submit false or misleading information or impersonate any other person.
  • You must not attempt to gain unauthorized access to any part of the Site, accounts, or systems.

6. Payment Terms

  • Expert consultation services are offered for a fee as indicated on the Site.
  • Payments are processed securely by third-party payment provider Stripe; we do not store your payment card details.
  • All fees are non-refundable except as required by law or as otherwise stated in our refund policy.

7. Refunds and Return Policy

  • If you are not satisfied with the expert consultation service, you may request a refund within thirty (30) days from the date your payment was received.
  • To initiate a return or refund, contact us at [email protected] with your order details and reason for your request.
  • Refunds will be processed to the original payment method within a reasonable period after approval.
  • No refunds will be issued after thirty (30) days from the payment date.
  • This policy applies only to expert consultation services purchased directly from our Site. It does not apply to skincare products recommended by Missing Skincare but purchased from third-party retailers.

8. Intellectual Property Rights

  • All content on the Site—including text, graphics, logos, software, and other materials—is owned or licensed by Missing Skincare and protected by copyright, trademark, and other laws.
  • You may not use, copy, reproduce, modify, distribute, or create derivative works from any content without our prior written permission.
  • You retain ownership of content you submit but grant us a worldwide, royalty-free license to use such content in connection with delivering our Services.

9. Disclaimer of Warranties

  • The Site and Services are provided “as is” and “as available” without warranties of any kind, either express or implied.
  • We do not warrant that the Site will be uninterrupted or error-free, nor do we make any warranty as to the accuracy, completeness, or reliability of any recommendation or content.
  • Skincare recommendations are for informational purposes only and are not a substitute for professional medical advice or treatment.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Missing Skincare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or Services.
  • Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount paid by you (if any) for paid Services in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Missing Skincare and its officers, directors, employees, agents, licensors, and affiliates from and against any claims, losses, liabilities, expenses (including attorneys’ fees), arising out of your use of the Site or Services, your violation of these Terms, or your violation of any rights of another.

12. Third-Party Services and Content

The Site may contain links to third-party websites or integrate with third-party services (such as payment processors). We are not responsible for the content or privacy practices of such third parties.

13. Termination

We reserve the right to suspend or terminate your access to the Site and Services at our discretion, without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Site will immediately cease.

14. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of California without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Sacramento County, California.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes constitutes acceptance of those changes.
